SMS Terms & Consent

These terms describe the automated text-message program operated by APOG SYSTEMS LLC ("APOG," "we," "us") in connection with our missed-call customer-care line. By calling APOG at our published business phone number, you may receive an automated SMS reply as described below.

Program description

When you call APOG and we are unable to answer, our system sends you one automated text message to the phone number that placed the call, inviting you to reply with what you need. Your reply is forwarded to APOG so we can respond. This is a transactional, customer-care program — not marketing, and not bulk messaging.

How consent works

Consent to receive the automated text-back is established by your own inbound call to APOG. We do not purchase, rent, or message phone numbers that have not first placed a call to us. If you do not wish to receive a text reply, do not call the line, or reply STOP to any message.

Verbal consent script

Consent is collected verbally, on the phone call itself. Every caller whose call we cannot answer hears the following recorded notice — this is the exact language, spoken word-for-word to the caller before any text message conversation begins:

"Thanks for calling APOG Systems. We can't answer right now, so we're sending a text message to the number you're calling from. Reply to that text with what you need and we'll get right back to you. Message frequency varies, and message and data rates may apply. Reply STOP to opt out, or HELP for help."

Simulated conversation (how the consent flow works)

  1. Customer action: The customer dials APOG SYSTEMS LLC's published business phone number to reach us.
  2. Missed call: APOG is unable to answer (on a job site or after hours).
  3. Verbal notice the caller hears: the recorded consent script quoted above, informing the caller that a text is being sent, that message frequency varies, that message & data rates may apply, and how to opt out (STOP) or get help (HELP).
  4. Confirmation text the customer receives: "Hi, this is APOG Systems — sorry we missed your call. Reply here with what you need and we'll get right back to you. Msg & data rates may apply. Reply STOP to opt out."
  5. Customer choice: The customer may reply with their request (continuing the conversation) or reply STOP to opt out, ending all messaging.

How consent is captured and recorded: The consumer's inbound call is the consent event, and the verbal script above is played on that same call. Each call is logged by our telephony provider (Twilio) with the calling phone number and a timestamp; that record is retained as proof of the inbound call and spoken notice that preceded the single automated reply.

How to opt out: Reply STOP to any message at any time — opt-out is processed immediately and no further messages are sent. Reply HELP for help.

Message frequency

Message frequency varies and depends on your interaction with us — typically one automated reply per unanswered call, plus any conversational replies you exchange with APOG.

Message and data rates may apply. Reply STOP at any time to opt out of further messages. Reply HELP for help. Opting out with STOP is processed immediately.

Privacy & your information

We do not sell your personal information. No mobile information — including phone numbers and SMS opt-in or consent data — is sold, rented, or shared with third parties or affiliates for their own marketing purposes. Phone numbers and message content are shared only with the service providers that help us deliver the messages (for example, our telephony provider) as needed to operate the program.
